Educators Financial Group ® F22 Q4 Pension Income Gap Calculator Promotion Terms & Conditions

The 2022 $25 Gift Card (the “Gift Card”) is promotion by Educators Financial Group Ltd. (“Educators” or “Educators Financial Group” or the “Sponsor”) and is subject to these terms and conditions (“Terms”). By participating in this Promotion, you agree to be bound by these Terms.

1 Promotional Period:

The promotion starts on April 28, 2022 and ends on November 30, 2022 at 11:59 p.m., Eastern Standard Time (the “Promotional Period”) or while gift card quantities last, whichever comes first.

2 Eligibility Requirements

To be eligible for the Gift Card, a person must (1) be either an active or retired teaching or non-teaching educational worker in Ontario or British Columbia, Canada, which includes staff of a board of education, a university, a college, a private educational facility, an education consortium or affiliate (including the Ontario Secondary School Teachers’ Federation and other education unions), or their family members, (2) be a resident of Ontario or British Columbia, (3) have reached the age of majority in their province of residence by September 30, 2022 and (4) not be an employee, representative or agent of, or domiciled with an employee, representative or agent of, Educators, its affiliates, marketing and advertising agencies, or suppliers, (4) Does not have one or more investment accounts with Educators Financial Group. This promotion cannot be combined with any other promotions.

3 How to Participate

3.1 Schedule and complete a complimentary consultation meeting with an Educators Financial Group Financial Advisor to review your Pension Income Gap results during the promotional period. By completing the complementary consultation, the individual may be eligible for one (1) $25 gift card.

3.2 There is a limit of one (1) gift card per eligible individual. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Terms; and/or (ii) use multiple names, identities or email addresses to participate in or to disrupt this Promotion; then he/she may be disqualified from the Promotion in the sole and absolute discretion of the Sponsor. A participant may be rejected if (in the sole and absolute discretion of the Sponsor) it is not fully completed with all required information and received in accordance with these Terms. The Released Parties (defined below) are not responsible for late, lost, misdirected, delayed, incomplete, illegible or incompatible promotion-related information (which is void). All participants are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government-issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Promotion; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Promotion-related information submitted or received (or purportedly submitted or received) for the purposes of this Promotion; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Promotion in accordance with these Terms and Conditions. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.

3.3 Documentation (a copy of the individuals Pension Income Gap calculator results) must be provided and a complimentary consultation meeting with an Educators Financial Group Financial Advisor must be completed no later than December 31, 2022. Upon completion of your complementary consultation and review of your Pension Income Gap calculator results you may be eligible to receive one (1) $25 gift card. If for any reason you cannot complete your complimentary consultation by December 31, 2022, you will no longer be eligible to receive a gift card.

4 Gift Card

There are a maximum eighty (80) cards of $25 each available to be given to eligible participants during the Promotional Period. There is a maximum of one (1) gift card per eligible individual.

5 Gift Card Fulfillment

Eligible participants will be contacted by email on or before January 13, 2023. In order to receive the gift card, the eligible participants will be required to sign and return a standard liability release and publicity release within 14 days of prize notification, and otherwise comply with the Terms. If an eligible participant cannot be contacted or has not responded within 5 business days, is not eligible in accordance with these Terms, does not sign and return any requested document within the specified time, or otherwise comply with these Terms, the eligible participant will be disqualified and will not receive the gift card. After January 31, 2023, all gift card claims shall be null, and void and no more gift card will be fulfilled.

6 General

6.1 All gift cards must be accepted as provided and are not transferable or substitutable and will be awarded to the eligible participant only.
6.2 All decisions of the Sponsor are final and binding on all participants and without appeal. The Promotion is subject to all applicable federal, provincial, and municipal laws.
6.3 By participating in the Promotion, you agree and acknowledge that Educators and the Ontario Secondary School Teachers Federation, their affiliates and advertising and contests agencies, and each of their respective employees, officers, shareholders, representatives, directors, and agents (collectively ‘Releasees’) are not responsible for and shall not be liable for any injury or other damage to person or property of any kind or any other liability arising from participation in the Promotion or use or misuse of a gift card. Participants assume all liability for any injury or damage caused, or claimed to be caused, directly or indirectly, in whole or in part, relating to this Promotion or receipt, use, or misuse of a gift card.
6.4 Sponsor and its agents are not responsible for any printing, distribution, production, or other errors and may terminate or withdraw the Promotion without liability and at their sole discretion. In no event will more than the number and type of gift cards listed in these rules be awarded.
6.5 Sponsor reserves the right to substitute a gift card with one of equal or greater value and to cancel, suspend, modify or amend the Promotion without prior notice at any time and for any reason. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with, or attempts to tamper with, the entry process or violates any of the Promotion Rules. Any attempt to undermine the legitimate operation of the Promotion is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right, in its sole discretion, to seek damages or other remedies from any such person(s) responsible to the fullest extent permitted by law.
6.6 Personal data gathered by Educators will be used to administer this Promotion and as otherwise permitted or required by law. No further informational or marketing communications will be received by participants unless participants provide explicit permission to do so. 6.7 The Promotion and the Promotion Terms and Conditions will be exclusively governed and construed in accordance with the laws of the province of Ontario. Any dispute arising hereunder shall be governed by the laws of Ontario and shall be adjudicated in the applicable court in Toronto, Ontario.
6.8 All currency referenced in these Terms and Conditions is in Canadian dollars.
